Art. 2 – Subject Matter

These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on http://oleificivasconi.it and do not govern, however, the provision of services or the sale of products by parties other than the seller that are present on the same site via links, banners, or other hyperlinks.
2. Before submitting orders and purchasing products and services from other parties, we suggest verifying their terms of sale.

Art. 3 – Conclusion of Contract
1. To conclude the purchase contract, it will be necessary to complete the electronic form and submit it following the relevant instructions.
2. It contains reference to the General Terms and Conditions of Sale, images of each product and its price, the payment methods that can be used, the delivery methods for purchased products and related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and the methods and timeframes for returning purchased products.
3. Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the Information on the right of withdrawal and the processing of personal data.
4. The contract is concluded when the seller receives the form completed by the user, subject to verification of the correctness of the data contained therein.
5. The user will be obligated to pay the price from the moment the online order submission procedure is completed. This will occur by clicking the “Purchase” button at the end of the guided procedure.
6. Once the contract is concluded, the seller takes charge of the order for its fulfillment.

Art. 4 – Registered Users
1. In completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.

Art. 5 – Product Availability
1. Product availability refers to actual availability at the time the user places the order. Such availability must nevertheless be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products may be sold to other customers before order confirmation.
2. Even after sending the order confirmation email, cases of partial or total unavailability of goods may occur. In this event, the order will be automatically adjusted by removing the unavailable product, and the user will be immediately informed via email.
3. If the user requests cancellation of the order, thereby terminating the contract, http://oleificivasconi.it will refund the amount paid within 10 days from the moment http://oleificivasconi.it became aware of the purchaser’s decision to terminate the contract.

Art. 7 – Payment Methods and Prices
1. The price of products will be as indicated from time to time on the site, except where an obvious error exists.
2. In case of error, http://oleificivasconi.it will notify the purchaser as soon as possible, allowing confirmation of the order at the correct amount or cancellation. In any event, http://oleificivasconi.it will not be obligated to supply the goods sold at the incorrectly indicated lower price.
3. Prices on the site are inclusive of VAT and do not include shipping costs. Prices may change at any time. Changes do not affect orders for which order confirmation has already been sent.
4. Once the desired products have been selected, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details may be modified before payment.

Art. 8 – Delivery
1. http://oleificivasconi.it ships throughout Italy, excluding Vatican City State and the Republic of San Marino.

3. Delivery is generally made within 5 days, or, if no delivery date is specified, within the timeframe estimated at the time of selecting the delivery method and, in any case, within a maximum of thirty days from the date of confirmation.
4. If delivery cannot be made, the order will be sent to the warehouse. In this event, a notice will specify the location of the order and the procedures for arranging a new delivery.
5. If you are unable to be present at the delivery location at the agreed time, please contact us again to arrange a new delivery date.
6. If delivery cannot take place for reasons not attributable to us after thirty days from the date the order is available for delivery, we will assume that you intend to terminate the contract.
7. As a consequence of termination, amounts will be refunded, including delivery costs with the exception of any additional costs arising from the choice of a delivery method other than the ordinary method offered, without undue delay and, in any case, within 10 days from the date of termination of the contract. Transportation resulting from termination of the contract may have additional costs that will be borne by the purchaser.
8. Shipping costs are borne by the purchaser and are explicitly indicated at the time the order is placed.

Art. 9 – Transfer of Risk
1. Risks relating to products will pass to the purchaser from the moment of delivery. Ownership of products is considered acquired upon receipt of full payment of all amounts due in relation to them, including shipping costs, or at the time of delivery, if this occurs at a later time.

Art. 10 – Warranty and Commercial Conformity
1. The seller is responsible for any defects in the products offered on the site, including non-conformity of items to the products ordered, pursuant to the provisions of Italian law.
2. If the purchaser has entered into the contract as a consumer, that is, any natural person acting on the site for purposes unrelated to any business or professional activity carried out, this warranty is valid provided that the defect manifests itself within 24 months from the date of delivery of the products; that the purchaser submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by them; and that the online return form is completed correctly.
3. In case of non-conformity, the user who has entered into the contract as a consumer will have the right to obtain restoration of product conformity without charge, through repair or replacement, or to obtain an appropriate price reduction or termination of the contract with respect to the contested goods and the consequent return of the price.
4. All return costs for defective products will be borne by the seller.

Art. 11 – Withdrawal
1. In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days pursuant to Art. 57 of Legislative Decree 206/2005, starting from the date of receipt of the products.
2. In case of multiple purchases made by the purchaser with a single order and delivered separately, the 30-day period runs from the date of receipt of the last product.

4. The purchaser must also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or, alternatively, by submitting the standard withdrawal form, as per Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.
5. Goods may be returned to any sales or pickup point in Italy, as indicated on the web page at the time of purchase.
6. Goods must be returned intact, in their original packaging, complete in all parts and with all accompanying tax documentation. Subject to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum of 4 days, including any shipping costs.
7. As provided by Art. 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the site may suspend the refund until receipt of the goods or until the purchaser has demonstrated that they have returned the goods.
8. The right of withdrawal will not apply if the services and products of http://oleificivasconi.it are included in the categories of Art. 59 of Legislative Decree 206/2005.
9. The site will execute the refund using the same payment method chosen by the purchaser at the time of purchase. In the case of payment made by bank transfer, and if the user intends to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT, and BIC necessary for processing the refund.

Art. 13 – Severability Clause
1. In the event that one of the clauses of these General Terms and Conditions of Sale is null and void for any reason, this will in no way compromise the validity and compliance with the other provisions appearing in these General Terms and Conditions of Sale.

Art. 15 – Applicable Law and Competent Jurisdiction

These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, subject to any different mandatory prevailing provisions of the country of habitual residence of the purchaser. Consequently, the interpretation, execution, and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law.
2. Any disputes inherent in and/or consequent to them must be resolved exclusively by the Italian judicial authority. In particular, if the user qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same in accordance with applicable law.

Pursuant to and for the purposes of Art. 14 of EU Regulation No. 524/2013, consumers residing in States belonging to the European Union are informed that for the resolution of disputes relating to this contract and the online services offered by this site, there is the possibility of resorting to the Online Dispute Resolution (ODR) procedure, provided by the European Commission, and accessible at the following link: https://webgate.ec.europa.eu/odr/.
